TERMS OF SERVICE FOR XGAMBA

Welcome to XGamba (referred to herein as "XGamba," "the Platform," "Company," "we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, mobile applications, APIs, services, prediction markets, and betting platform (collectively, the "Services").

By accessing, creating an account, or participating in any betting, prediction markets, or activities on the Platform, you agree to be bound by these Terms and our [Privacy Policy]. If you do not agree to these Terms, you must not access or use the Services.

1. ELIGIBILITY & USER REPRESENTATIONS

By creating an account and participating on XGamba, you represent and warrant that:

  1. Age Requirement: You are at least 18 years of age (or the minimum legal age required to engage in betting activities in your jurisdiction, whichever is higher).

  2. Jurisdiction Restrictions: You reside in and are accessing the Platform from a jurisdiction where online betting, sports wagering, and prediction markets are permitted by law. It is your sole responsibility to ensure your use of XGamba complies with local laws.

  3. Capacity: You have full legal capacity to enter into a binding legal contract.

  4. Prohibited Persons: You are not:

    • Listed on any list of sanctioned individuals or entities maintained by national or international bodies (e.g., OFAC, EU, UN).

    • An employee, director, officer, contractor, or agent of XGamba (or an immediate family member of the same), unless expressly permitted in writing by XGamba management.

    • An athlete, referee, coach, or official capable of influencing the outcome of any event or market listed on the Platform.

    • Prohibited from gambling or betting by any law, contract, or existing self-exclusion agreement.

2. ACCOUNT REGISTRATION & SECURITY

2.1 Account Creation

To access betting features, you must register for an account. You agree to provide accurate, current, and complete information during registration (including full name, date of birth, address, email, and phone number) and to keep this information up to date.

2.2 Account Security

  • You are solely responsible for maintaining the confidentiality of your credentials (username, password, two-factor authentication).

  • You accept full responsibility for all activities, bets, trades, or transactions executed under your account.

  • You must notify XGamba immediately at support@xgamba.com if you suspect unauthorized access or a security breach.

2.3 One Account Policy

Users are strictly limited to one (1) account per person, physical address, IP address, and financial instrument/wallet. Duplicate accounts found on the Platform may be suspended or permanently terminated, and any active bets or winnings may be voided at XGamba’s sole discretion.

3. IDENTITY VERIFICATION & COMPLIANCE (KYC / AML)

XGamba operates under strict Know Your Customer (KYC) and Anti-Money Laundering (AML) regulatory standards.

  1. Identity Verification: We reserve the right to verify your identity at any time, including requesting official government-issued ID, proof of residence (e.g., utility bill), and proof of payment ownership.

  2. Deposit & Withdrawal Limits: We may place temporary caps or delays on deposits and withdrawals pending successful completion of KYC procedures.

  3. Account Hold / Seizure: If you fail identity verification, provide fraudulent documents, or engage in suspicious transaction patterns, XGamba reserves the right to freeze your account, decline transactions, and report suspicious activity to law enforcement agencies.

4. DEPOSITS, WITHDRAWALS & FUNDS MANAGEMENT

4.1 Deposits

  • Deposits may be made using supported cryptocurrencies, as available).

  • You must only use financial instruments legally owned by you. Third-party deposits are strictly prohibited and will be rejected or refunded, XGamba has the ultimate right to refuse withdrawals and return deposits under special circumstances.

4.2 Withdrawals

  • Withdrawals will only be processed to payment methods registered to your XGamba account.

  • Withdrawals are subject to processing times, minimum/maximum transaction thresholds, and applicable processing fees.

  • Before processing a withdrawal, XGamba reserves the right to perform AML audits and require account re-verification.

4.3 No Interest on Held Funds

XGamba is not a banking institution. User balances do not accrue interest, regardless of how long funds remain in an account.

5. PREDICTION MARKETS, BETTING & SETTLEMENT RULES

5.1 Market Rules

Every prediction market, sports event, or novelty outcome on XGamba operates according to specific market rules listed on the event page. It is your responsibility to read and understand the rules before placing a bet.

5.2 Placing Bets & Placement Finality

  • A bet or prediction is considered valid once confirmed by our system and assigned a unique Transaction ID.

  • Once placed and accepted, bets cannot be canceled, amended, or revoked by the user.

5.3 Event Settlement & Resolution

  • XGamba uses verified data providers, official governing body statistics, or reputable third-party Oracles to settle market outcomes.

  • In the event of conflicting statistics or ambiguous outcomes, XGamba reserves final authority in determining market resolution.

  • If an event is postponed, canceled, abandoned, or corrupted by external interference, XGamba reserves the right to declare the market void and refund stakes to users.

5.4 System Errors & Obvious Mistakes

If a market displays an obvious pricing error ("Palpable Error" / "Palp"), incorrect start time, or faulty odds due to human, technical, or algorithmic error, XGamba reserves the right to:

  1. Void bets placed at erroneous odds and refund the stake, or

  2. Re-settle affected bets at the correct market value.

6. PROHIBITED CONDUCT & FRAUD PREVENTION

You agree not to engage in any of the following prohibited behaviors:

  • Syndicate / Automated Betting: Using bots, automated software, scripts, or collaborating with a group/syndicate to manipulate odds or circumvent betting limits.

  • Match-Fixing & Insider Information: Placing bets based on non-public, confidential, or insider information, or participating in match-fixing activities.

  • Arbitrage Fraud & Exploits: Exploiting system bugs, latency advantages ("courtsiding"), pricing glitches, or software loopholes.

  • Money Laundering: Utilizing the Platform to obscure the origin of illegally obtained funds or transfer money between accounts.

Enforcement: Breach of these conduct rules will result in immediate account termination, forfeiture of balance/winnings, and potential legal action.

7. RESPONSIBLE GAMBLING

XGamba is committed to promoting safe and responsible gambling practices.

  • Self-Exclusion & Limits: Users can set daily, weekly, or monthly deposit limits, loss limits, or voluntarily request a cooling-off period or permanent self-exclusion through their account settings or by contacting support@xgamba.com.

  • Account Closure: During a self-exclusion period, your account will be locked, and marketing communications will cease.

  • Help Resources: If you or someone you know is struggling with gambling addiction, please reach out to international help organizations such as BeGambleAware or Gamblers Anonymous.

8. INTELLECTUAL PROPERTY

All software, user interface design, logos, trademarks, data feeds, graphics, and underlying code associated with XGamba are the exclusive intellectual property of XGamba or its licensors. You are granted a limited, non-exclusive, non-transferable license to access the Platform solely for personal, non-commercial use in connection with prediction markets and betting.

9. DISCLAIMER OF WARRANTIES

  1. "AS IS" Basis: The Services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.

  2. No Guarantee of Availability: We do not guarantee that access to the Platform will be continuous, uninterrupted, timely, secure, or error-free.

  3. Third-Party Services: XGamba is not responsible for losses caused by third-party service providers, payment gateway failures, or Internet connectivity outages.

10. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law:

  • No Indirect Damages: XGamba, its directors, employees, or partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, data, or goodwill) arising out of or in connection with your use of the Services.

  • Liability Cap: In no event shall XGamba’s total liability to you for all claims exceed the lesser of:

    1. The total fees paid by you to XGamba in the three (3) months preceding the claim, or

    2. $1,000 USD (or local currency equivalent).

11. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless XGamba, its affiliates, directors, officers, employees, and agents from and against any claims, liabilities, damages, judgments, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or related to:

  • Your breach of these Terms;

  • Your violation of any applicable local, state, national, or international law; or

  • Your improper or illegal use of the Platform.

12. AMENDMENTS & MODIFICATIONS

XGamba reserves the right to update or modify these Terms at any time. When updates occur, we will update the "Last Updated" date at the top of this document and notify users via email or a prominent notice on the Platform. Continued use of XGamba following any modifications constitutes your acceptance of the revised Terms.

13. TERMINATION

  • Termination by You: You may close your account at any time by contacting customer support, provided all pending bets are settled and account balances are resolved.

  • Termination by Us: XGamba may suspend or terminate your account, freeze funds, or revoke access to the Platform immediately without notice if you violate these Terms, engage in fraud, or if required by law enforcement or regulatory authorities.

14. GOVERNING LAW & DISPUTE RESOLUTION

  1. Governing Law: These Terms shall be governed by and construed in accordance with the laws of [Insert Applicable Jurisdiction/Licensing Region], without regard to its conflict-of-law principles.

  2. Informal Negotiation: Before filing a formal claim, you agree to attempt to resolve any dispute informally by contacting customer support at hello@xgamba.com.

  3. Binding Arbitration: Any unresolved dispute, controversy, or claim arising out of or relating to these Terms shall be settled by binding arbitration in accordance with the arbitration rules of [Insert Designated Arbitration Authority, e.g., LCIA, AAA, or ICC]. Judgment on the award rendered by the arbitrator(s) may be entered in any court having jurisdiction thereof.

15. MISCELLANEOUS

  • Severability: If any provision of these Terms is found to be invalid or unenforceable, that provision will be severed, and the remaining provisions will remain in full force and effect.

  • No Waiver: Failure by XGamba to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.

  • Assignment: You may not assign or transfer your rights or obligations under these Terms. XGamba may assign its rights and obligations to a successor entity without restriction.
